Terms of Service
Effective Date: September 10, 2026 · Last Updated: September 10, 2026
1. Introduction
These Terms of Service (the “Terms”) govern access to and use of the Data Hydrant website and the hydrant data collection application and web-based management platform (the “Platform”) provided by Data Hydrant Inc.
By accessing or using the website or the Platform, you agree to these Terms. If you do not agree, do not use the website or the Platform.
2. Relationship to Client Service Agreements
The Platform is provided to water municipalities, fire departments, and related public agencies under annual contractual agreements (each a “Client Agreement”).
These Terms do not override or replace contractual terms agreed to in Client Agreements. Where a Client Agreement applies to your use of the Platform, the Client Agreement governs, and it controls over these Terms in the event of any conflict.
These Terms otherwise apply to visitors to our website and to any use of the website or the Platform not covered by a Client Agreement.
3. Accounts & Access
Platform accounts are created only for authorized personnel of a client under a valid Client Agreement. If you are issued an account, you agree to:
- Keep your login credentials confidential and not share your account
- Promptly notify your organization or Data Hydrant Inc. of any suspected unauthorized access
- Use the Platform only within the scope your organization has authorized
4. Acceptable Use
You agree not to:
- Use the website or the Platform for any unlawful purpose, or the Platform for anything other than authorized governmental purposes
- Attempt to gain unauthorized access to the Platform, to other accounts, or to data belonging to another client
- Probe, scan, or test the vulnerability of the Platform, or circumvent its security or access controls, except as authorized in a Client Agreement
- Interfere with or disrupt the operation of the website or the Platform
- Upload malicious code, or knowingly submit false or misleading data
- Copy, scrape, or harvest content or data from the website or the Platform by automated means
- Reverse engineer, decompile, or attempt to derive the source code of the Platform, except as permitted by law
5. Data Accuracy & Completeness
Data Hydrant Inc. does not guarantee or imply comprehensive inclusion of all hydrant data within the system. While Data Hydrant Inc. strives to provide accurate and reliable data, discrepancies or errors may occur in the data, data collection, entry, or interpretation stages.
Figures and reports in the Platform reflect the inspection and testing records entered in it; their completeness depends on data provided by the client. Operational conditions of hydrants and test results reflect conditions of the hydrants and system at the time of the inspections or tests. Data Hydrant Inc. does not guarantee, certify, or imply future pressures or operability of the hydrants at any time before, during, or after tests are conducted.
6. Intellectual Property
The website and the Platform, including their software, design, text, graphics, logos, and trademarks, are owned by Data Hydrant Inc. or its licensors and are protected by intellectual property laws. Except as provided in a Client Agreement, no license or other right in them is granted to you, and you may not copy, modify, distribute, or create derivative works from them.
Hydrant, asset, inspection, and related infrastructure data entered into the Platform by a client (“Client Data”) remains the property of that client. Nothing in these Terms transfers ownership of Client Data to Data Hydrant Inc.
7. Privacy
Our Privacy Policy describes how we collect, use, and protect information through the website and the Platform, including how Client Data is owned and handled.
8. Disclaimer of Warranties
Except as expressly provided in a Client Agreement, the website and the Platform are provided “as is” and “as available.” To the fullest extent permitted by law, Data Hydrant Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the website or the Platform will be uninterrupted or error-free.
9. Limitation of Liability
Except as expressly provided in a Client Agreement, and to the fullest extent permitted by law, Data Hydrant Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to the use of, or inability to use, the website or the Platform.
Where a Client Agreement applies, liability between Data Hydrant Inc. and the client is governed by that agreement.
10. Suspension & Termination
We may suspend or terminate access to the website or the Platform for violation of these Terms, or to protect the security or integrity of the Platform. Termination of a client’s Platform access, and the handling of Client Data afterward, is governed by the applicable Client Agreement.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles, except where a Client Agreement or the law applicable to a public entity provides otherwise.
12. Changes to These Terms
We may update these Terms from time to time. Updates will be posted with a revised “Last Updated” date.
